When users click "Agree" and go to the next step during the process of registration, it shall be deemed that the users have fully acknowledged and agreed to all of the Service Terms. SF Express is entitled to revise the terms based on the businesses and make announcement on the website. If users do not agree to such amendments, the users shall immediately stop using the "Services". The amended "Terms" shall take effect once published on SF Express' official website. If users continue to use the "Services", it shall be deemed that the users have accepted the amended "Service Terms". Upon occurrence of any dispute between the users and SF, the latest "Service Terms" shall apply. The service agreement shall include the agreement text and all kinds of rules published or to be published by SF. All rules shall be an integral part of the agreement and have the same legal effect as the agreement text.
2. "My SF" offers only self-service modules such as order placement and tracking. Other web devices (including PCs, mobile phones and other web devices relating to Internet access or mobile network access) relating to the Services and required fees (telephone bills, Internet fees, mobile phone charges paid for accessing mobile network, etc.) shall be at the cost of users.
II. User Terms
1. Users without a membership: It means users who have not completed the registration but may access "My SF" and use limited Services via web devices (including without limitation PCs, mobile phones and tablet PCs). If users have already registered the membership but did not login when using the Services, the users will be deemed as users without a membership.
2. "My SF" allows users without a membership to use limited services, which specifically include order placement for shipping, shipment tracking and shipment information query by waybill number.
3. Users without a membership may register their membership by mobile verification or otherwise.
III. Membership Registration
1. When registering, users must complete their accurate, true and valid personal information. In case of any incorrect information included in the information provided, our website reserves the right to disqualify the users in using the network services. In case that any user provides any untrue, inaccurate, incomplete information or information that cannot reflect the current situations, or SF Express suspects on reasonable grounds that such information is untrue, inaccurate, incomplete or cannot reflect the current situations, SF Express shall have the right to suspend or stop your registration identity and materials and reject your existing or subsequent use of the "Services"(either all or any part thereof) in any form. User names shall not include any information against national laws and regulations, suspected of infringing the rights of others or interfering with SF Express' normal operation order. One username can be used for registration of one account only and the valid mobile phone number used for verification shall not be used for other accounts. The mobile phone number used for user registration shall be a unique identification of membership. To guarantee the safety of users' accounts and avoid any unnecessary loss, users shall timely modify in case of any change to the mobile phone number.
2. Users shall complete the information, set up password, read and agree to the agreement, and go through all registration procedures as allowed by “My SF” of SF Express. “My SF” of SF Express will identify the membership by the member user name and password. Users shall be fully responsible for the account and password security and be legally liable for all activities and events carried out by using their accounts. In case of any illegal use of membership account, password and other security breach, users shall notify our website immediately. Users understand that SF Express may need reasonable time to take actions on users' requests, and SF will assume no liability for any consequence (including without limitation any loss against users) generated before such actions are taken.
3. After the user is registered successfully and set up corresponding password, the user can log on the account information page of the website at any time and change the basic information.
IV. Rules of Use
1. When using "My SF", users shall follow the rules below, or otherwise, "My SF" shall have the right to make its independent judgments and immediately disqualify the users' membership and cancel other accounts of the users:
(1) Abide by national laws and regulations, local regulations and Internet-related rules.
(2) Abide by all agreements, provisions and procedures relating to the waybill and tracking services and the Service Terms of this website.
(3) Do not use network services for illegal purposes.
(4) Do not use service systems of "My SF" to do any act that might possibly impose an adverse influence on normal operation of the Internet or mobile network.
(5) Do not use the order placement and tracking services of "My SF" to upload, display or spread any false, harassing, slanderous, abusive, vulgar, obscene or any other illegal information or data.
(6) Provide accurate personal information when applying for use of the order placement and tracking services of "My SF", and update in a timely manner in case of any change to the same.
(7) Allow "My SF" to send relevant business information to members via email or otherwise.
(8) Do no act that might prejudice the interests of this website.
(9) Do not obtain members' information by improper means such as account, password stealing and fraud.
(10) Do not lend or transfer the account to others.
(11) Do not trade the membership account as a commodity (e.g. sale or sale by auction of the membership account).
(12) Do not leave "My SF" when leaving the website, but leave the website by following the correct steps at the end of each online access.
2. Any statement, notification, warning and etc. on the use of some specific services made by "My SF" by all means (including without limitation webpage announcements, email, SMS, etc.) shall be deemed as a part of the Service Terms. If users are using such services, it shall be deemed that the users agree to such statement, notification, warning and etc.
3. For any content uploaded by users to the public domain of "My SF" for using order placement and tracking services, users agree that this website has the free, permanent, irrevocable, non-exclusive and fully permissible right throughout the world to use, duplicate, modify, adapt, publish, translate, create derivative works from, spread, give a performance of and display such content (all or part thereof), or compile such content into the currently known or subsequently developed works, media or technologies of any other forms.
4. End of service:
(1) Users or "My SF" may suspend one or multiple network services at any time as the case may be. "My SF" may suspend the Services at any time without assuming liability to any individual or third party. If users have any objection against subsequent amendments of the Service Terms, or are not satisfied with the services of My SF, the users may exercise the following rights:
① Stop using “My SF” network services.
② The Notifications of “My SF” stop services to users.
(2) After the user service ends, users’ right on using network service stops immediately. Starting from the end of service, "My SF" will be exempted from the obligation of transmitting any unprocessed information or unfinished service to any user or third party.
V. Members’ Privacy Policy
Respecting and protecting members’ privacy is a basic policy of “My SF”. Members agree that “My SF” uses members’ information based on the following specified purposes.
1. “My SF” promises that it will not publicize, edit or disclose members’ personal information without consent of members, except the following circumstances:
(1) Gain clear authorization from members;
(2) Based on requirements on related laws and regulations;
(3) Based on requirements of government authorities;
(4) To protect the interests of the social public;
(5) To protect the legal rights of SF Express.
2. User name and password
After the user registered as a member of “My SF” and set up the password, the user can use member account with the password. If the password is disclosed, the personal identification information will be stolen and may lead in judicial acts harmful to the users. No matter the password security is endangered by whatever reasons, the user shall contact “My SF” immediately.
3. Information for Order Placement
When a member places an order on “My SF”, the member shall provide true, accurate and complete information such as shipper’s and receiver’s addresses, consignment information, contact person, contact phone and payment mode so that this website may process the waybill and the waybill status.
4. Member Email/SMS
(1) “My SF” reserves the rights to send information and activity notice to registered members of this website by means of email, SMS and mailing brochure. If the user registers in “My SF”, it indicates that the user accepts this service by default.
(2) If a member is unwilling to receive such notifications, the member may unsubscribe to “My SF” and note down the email address, mobile phone No., and related address information. After “My SF” receives the application, it will unsubscribe for the user.
5 Order Placement Behavior
Tracking IP address by “My SF” is only for the necessity for security. If no security problem is found, please delete the IP address collected by this website timely. The website will follow the page access data for the whole day. The page access data in the whole day is used to reflect the website traffic. My SF can plan for future development, such as adding server.
6. Third-party
“My SF” will not provide, sell, lease, share and transact members’ personal information to any third party, except that the third party and “My SF” provide services for the website or users together, and after the end of the services, all of such materials will be prohibited for accessing. As “My SF” is compulsorily required by laws or the government to provide members’ information, our website will disclose members materials in good faith.
7. Information storage and exchange
The member information and materials are collected and stored in servers in China. Only for the necessity of backup can “My SF” transmit members’ materials to servers in other countries.
8. External link
When members select links of other websites or advertisements, they will enter third party’s website, “My SF” will not bear any liability for the privacy protection of those websites.
9. Security
“My SF” adopts related security measures to protect the information mastered by this website from loss, abuse and compiling. These measures include back up data on other servers and encryption of members’ passwords. Although these measures are used by this website, please be noted that there are no sound security measures on the Internet. “My SF” reserves the rights to reject order placement with doubt and suspected credit fraud at any time.
VII. IPR Statements
1. All contents contained on website of “My SF”, including all texts, images, graphics, audio and video, shall be the properties of this website and be protected by the laws of copyright, trademark and other property ownership. Without the consent of this website, no enterprise or individual shall have the right to duplicate, download, transmit or reproduce any content of this website, or offer the same to any third party for use. If any loss is caused to the company due to violation of the above statements, the company will investigate and affix legal liability by law.
2. Any and all rights to any software used by “My SF” for the purpose of providing order placement and tracking services (including without limitation any image, photo, animation, video, audio, text, add-in program or attached supporting materials) shall belong to the copyright owner of such software. Without the permission of the copyright owner, no user shall reverse engineer, decompile or disassemble such software.
VII. Disclaimer
1. Users expressly agree that risks in and any and all consequences of using the order placement and tracking services on “My SF” shall be fully at their own cost.
2. “My SF” will neither guarantee that the Services can definitely meet all demands of users, nor guarantee that the Services will not be interrupted or the Services will be provided timely, safely or without any mistake.
3. For interruption or other defects of the order placement and tracking services caused by force majeure or reasons beyond “My SF”’s control, “My SF” will not assume any liability but will endeavor to help deal with it so as to reduce the loss to and impact on users.
4. Leakage of any individual information or loss of shipments caused by other reasons, for example, the user told or disclosed to another person the verification code, the user’s mobile phone or other devices were stolen, the user shared his or her account with another person, or the user lent or transferred the account to another person for use, shall be at the cost of the user, and “My SF‘and SF Express will not assume any liability.
5. “My SF” will not assume any liability for users’ failure of using the Services of this website or other losses arising therefrom due to the users’ provision of incorrect, incomplete or untrue information to “My SF”.
6. “My SF” will not guarantee that all SMS sent by SF Express will be delivered without missing or successfully. If the SMS cannot reach the users instantly or accurately due to force majeure factors such as network paralysis and poor network connection of the users’ mobile phone for SMS receiving caused by reasons such as abnormal network operation of the SMS carrier, natural and man-made disasters and wars, SF Express will not assume any liability.
7. “My SF” and their contents are provided on the basis of the existing information, and “My SF” provides only order placement and tracking services. Therefore, this website will neither make any direct, indirect, accidental, derivative and punitive compensation for damages (including monetary gains and intangible losses) nor assume any legal liability (unless otherwise implied by law) for any losses arising from the contents of this website.
8. “My SF” will offer links to other websites that are not controlled by “My SF”. Therefore, “My SF” will not assume any liability for the contents of these websites and updates or changes thereof, and the use and contents of these website do not represent the standpoint of “My SF”.
9. The mobile phone number you used upon registration shall be the unique identification of your membership and shall be modified in a timely manner in case of any change. “My SF” will not be liable for any loss such as account number being stolen or leakage of individual information caused by users’ failure of timely modification of the mobile phone number due to their own reasons, but our website will endeavor to help deal with it so as to reduce the impact of the users.
VIII. Notifications
My SF will send notifications to users by means of notifications, announcements, emails, SMS or otherwise, and such notifications shall be deemed as successfully delivered to the recipient on the date of sending.
IX. Compensation for Breach of Contract and Limitation of Liability
1. For any loss caused to "My SF" due to users' violation of relevant laws, regulations and the Service Terms of this website, users agree to be liable for damages arising therefrom.
2. Users agree that "My SF" will not assume any legal liability for losses against users caused by use of this website, and also agree to waive the right of claim against "My SF". Where such statement is inapplicable to some individual cases, "My SF"'s liability shall be limited to the amount paid by the user for order placement on this website.
X. Governing Law
1. The execution, performance, construction and dispute resolution of this agreement shall be governed by the laws and courts of China.
2. In case of any conflict between the Service Terms of “My SF” and the laws of China, the contradictory Terms will be completely reinterpreted in accordance with the provisions of the laws while other legal Terms will still have legal effect and influence on users.
If any dispute arises from the contents and execution of this agreement between both parties, both parties shall try to negotiate and solve the problem friendly; If the negotiation fails, either party can file a lawsuit to People's Court of Futian District of Shenzhen.
